B. OBLIGATIONS OF THE DATA CONTROLLER

The data controller undertakes to protect the personal data collected, not to transmit it to third parties without your having been informed thereof, and to respect the purposes for which such data was collected.

Furthermore, the data controller undertakes to notify you in the event of rectification or erasure of data, unless doing so would entail disproportionate formalities, costs, and steps.

In the event that the integrity, confidentiality, or security of your personal data is compromised, the data controller undertakes to inform you thereof by any means available.

KSGB Europe will specify the measures for deletion/modification of your data in light of its legal obligations and authorizations.

Right of rectification: You have the right to request the rectification of your personal data if it is inaccurate, including the right to have incomplete personal data completed. If you have a personal account, you may modify your personal data on your account page. You may also send us an email at dpo@ksgb.com to request the rectification of your personal data.

 

Right to erasure: You have the right to erase, at any time, the personal data processed by KSGB Europe, except in the following situations:

·        you have an ongoing issue with customer service;

·        you have an open order that has not yet been dispatched or has only been partially dispatched;

·        you have an outstanding debt with KSGB Europe, regardless of the method of payment;

·        you have made a purchase, in which case we will retain your personal data in connection with your transaction, in accordance with applicable law and the customer and accounting data retention periods set out above.

If you have a personal account, you have the right to request its deletion by following the procedure below:

You may request the complete deletion of your personal account, in compliance with the applicable legal retention provisions set out above, by contacting dpo@ksgb.com.

b. Right to data portability

You have the right to request the portability of your personal data held by the website to another website, in accordance with the following procedure:

Whenever KSGB Europe processes your personal data by automated means on the basis of your consent or on the basis of a contract entered into between you and us, you have the right to receive a copy of your data transferred to you or to a third party. This applies only to the personal data you have submitted to us.

c. Right to restriction and right to object to the processing of data

You have the right to request the restriction of, or to object to, the processing of your data by the website, and the website may not refuse such a request unless it can demonstrate the existence of compelling legitimate grounds that override your interests, rights, and freedoms.

f. Right to lodge a complaint with the competent supervisory authority

B. PERSONAL DATA OF MINORS

In accordance with the provisions of Article 8 of European Regulation 2016/679 and the French Data Protection Act (loi Informatique et Libertés), only minors aged 16 years or older may consent to the processing of their personal data.

“loi Informatique et Libertés" is the French national data protection law (Law No. 78-17 of 6 January 1978, as amended). There is no direct English equivalent.

KSGB Europe uses tracking pixels in the emails it sends to its customers and newsletter subscribers.

A. DEFINITION

A tracking pixel (or "tracking pixel") embedded in an email is an extremely small image (1×1 pixel) which, when the message is opened by its recipient, automatically sends a request to the sender's server. This technique enables the collection of information regarding consultation of the message, such as the date and time of opening, the type of device and email client used, and the recipient's IP address.

B. PURPOSE

KSGB Europe uses tracking pixels in emails for the following purposes:

Purposes requiring your prior consent:

·        Measuring and optimizing the performance of our marketing campaigns (open rates, opening time, personalization of content and sending frequency);

·        Building a profile of your areas of interest in order to offer you tailored content or advertisements on other channels (website, social networks, applications);

·        Detecting and analyzing suspected fraud (mass registrations, automated behavior).

·        Purposes exempt from the consent requirement (but of which we inform you in the interest of transparency):

·        Securing the authentication of your account (for example, verifying that the email containing a login code is opened on a recognized device);

Measuring, in a strictly limited manner, the email open rate in order to manage our mailing lists (identification of inactive addresses, adjustment of sending frequency), applicable solely to transactional emails or those in respect of which you have given your consent.

C. LEGAL BASIS AND CONSENT

In accordance with the recommendations of the CNIL and Article 6.1(a) of European Regulation 2016/679 (GDPR), the use of tracking pixels in emails is subject to the prior consent of the user. Such consent is collected at the time of newsletter subscription or through the preferences manager accessible in each email.

 

If your consent could not be collected at that time, we may subsequently contact you via a dedicated email, without a tracking pixel, containing an individual link enabling you to express your choice.
